Agreement

These Terms of Service govern your access to and use of the RESONATE website, checkout, downloads, and audio plugin provided by The Seeker. By purchasing, downloading, installing, or using RESONATE, you agree to these terms.

License

Subject to your compliance with these terms, The Seeker grants you a limited, non-exclusive, non-transferable license to install and use RESONATE for your own music, sound design, audio production, and related creative work.

You may not redistribute, resell, sublicense, rent, lease, share, publish, reverse engineer, decompile, or otherwise attempt to derive the source code or underlying implementation of RESONATE, except where such restriction is prohibited by applicable law.

Purchases And Downloads

USD purchases are handled by itch.io and may be subject to itch.io's payment, delivery, refund, and account terms. BTC purchases are handled directly through this website. You are responsible for sending the correct amount to the correct address within the invoice window and for any transaction fees charged by your wallet or network.

BTC transactions are generally irreversible. Refunds, replacements, or manual support for incorrect payments may be provided at The Seeker's sole discretion and are not guaranteed.

User Responsibility

You are solely responsible for how you install, configure, and use RESONATE, including any audio output, project files, live performance use, commercial releases, system compatibility decisions, backups, and compliance with laws, rules, contracts, licenses, or platform requirements that apply to your work.

No Warranties

RESONATE, the website, checkout, and downloads are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, The Seeker disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, compatibility, and accuracy.

Limitation Of Liability

To the fullest extent permitted by law, The Seeker will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for lost profits, lost revenue, lost data, lost projects, lost audio work, business interruption, equipment issues, software conflicts, or other losses arising out of or related to RESONATE, the website, checkout, or downloads, even if advised of the possibility of such damages.

To the fullest extent permitted by law, The Seeker's total liability for any claim arising out of or related to RESONATE, the website, checkout, or downloads will not exceed the amount you paid for RESONATE.

Indemnity

You agree to defend, indemnify, and hold harmless The Seeker from and against claims, liabilities, damages, losses, and expenses arising from your misuse of RESONATE, violation of these terms, violation of law, or infringement of any rights of another person or entity.

Updates And Availability

The Seeker may modify, update, suspend, or discontinue RESONATE, the website, checkout, downloads, or update access at any time. Optional update emails may be used to notify buyers of future updates, but no particular update, feature, compatibility target, support period, or continued availability is guaranteed unless expressly stated in writing.

Changes

The Seeker may update these Terms of Service from time to time. Continued use of RESONATE or the website after changes are posted constitutes acceptance of the updated terms.
